Negotiated Settlement Agreement between MSA and BP is Approved.

The AUC has ruled on the negotiated settlement agreement (NSA) between the Market Surveillance Administrator (MSA) and the Balancing Pool (BP) in Decision 23828-D02-2020.[1]

MSA and the Balancing Pool Revised Settlement Agreement on the Termination of PPAs

The Alberta Utilities Commission (the Commission) reviewed the Market Surveillance Administrator’s (MSA) application for approval of a settlement agreement pertaining to the termination of power purchase arrangements (PPAs) between the MSA and the Balancing Pool of Alberta (BP). In the proceeding, the Commission released a decision in part through Decision 23828-D01-2019 [1]where they referred the settlement back to the MSA and BPA and advised that the settlement be revised to address concerns that the Commission had.

Government of Alberta’s Response to Terminated PPAs

On July 25, 2016, the Attorney General (AG) of Alberta on behalf of the Government of Alberta submitted an application to the Court of Queen’s bench to effectively reverse ENMAX’s termination of their Battle River Power Purchasing Arrangement.¹   The balancing pool is also named in the application because it accepted ENMAX’s termination of the PPA. The other PPA holders are named as respondents because they have termination requests pending.
