ATCO Utilities that they routinely submit cost claims that are in excess of the AUC’s scale of costs set out in Rule 002, most frequently in regards to legal fees. In response, the Commission (with equal frequency) limits or disallows partial costs to effectively bring legal fees in line with the price cap.

MSA State of the Market

On November 27, 2014 the MSA released the 2014 State of the Market Report with a specific focus on the retail market. The MSA’s overall assessment is that that the Alberta retail market is competitive, but that this is inconsistent across the province, with some regions lacking retail competition.

On November 25, 2014 EPCOR Distribution and Transmission Incorporated (EDTI) submitted their 2015-17 transmission tariff application. EDTI requests Commission approval for revenue requirement of $100.84M in 2015; $102.14M in 2016; and $107.79M in 2017.

TAC Deferral Account – Quarterly Applications

Recall from the previous Industry Update that the Commission initiated a consultation with distribution utilities Fortis Alberta (Fortis), Enmax Power Corporation (ENMAX), ATCO Electric (ATCO) and EPCOR Distribution and Transmission (EPCOR) to discuss possible refinements to the standardized methodology for quarterly AESO demand transmission service (DTS) deferral account rider applications as well as the potential for harmonizing the content and structure of the distribution facility owner’s (DFO) annual transmission access charge (TAC) deferral account applications.

Transmission Constraint Management Cost Recovery

Recall from the previous industry update that the AESO has been conferring with market participants on a revised Transmission Constraint Management (TCM) Rule. Part of the revision includes modifying how the AESO recovers costs related to Real Time Transmission must run (RTMR). In October, the AESO responded to stakeholder comments on proposed changes.

ASSET DISPOSITION APPEAL

The Alberta Court of Appeal has granted the Alberta Utilities (ATCO Gas and Pipelines Ltd, AltaGas Utilities Inc., FortisAlberta Inc., ATCO Electric, Enmax Power & Distribution and EPCOR Distribution and Transmission Inc.) leave to appeal two Commission decisions related to utility asset disposition.
